The Boston Pre-Release Center at 430 Canterbury Street in Roslindale handles inmates nearing release. Each facility takes booking photos when someone enters custody. Mugshot Access Laws in Suffolk County
The 2020 Supreme Judicial Court case Boston Globe Media Partners v. DCJIS, 484 Mass. 279, was a landmark ruling for busted mugshots access. The court held that mugshots are not automatically exempt from public records law under the CORI Act. This means police in Suffolk County cannot block a mugshot request just because the photo is in a criminal file. They need a specific legal exemption to deny the request.
Under M.G.L. c. 41, Section 98F, every police department must keep a daily log of arrests. These logs show the person's name, charges, time, and place of arrest. The daily log is a public record and separate from CORI. This is often the easiest way to confirm an arrest happened in Suffolk County before requesting the busted mugshot itself. Police departments in Boston, Chelsea, Revere, and Winthrop all maintain these logs.
Record sealing is possible in Suffolk County. Under M.G.L. c. 276, Section 100A, misdemeanor convictions can be sealed after five years. Felonies take 10 years. Non-conviction records now seal automatically under Section 100C. Sealed busted mugshots are no longer available through standard public records requests.
